    What You Can't Advertise in Ukraine: 2026 Guide

    The video is ready, the budget is signed off, the launch date is in the calendar — and then moderation sends the creative back. Or worse: the ad goes live, and a month later a letter arrives from the consumer protection service with a fine calculated from the value of the advertising you distributed.

    To avoid that, it pays to know in advance what you can't advertise in Ukraine and what the advertising law actually requires from an ordinary creative. Below is a practical checklist for any business planning a campaign: what is banned outright, what is allowed with mandatory disclaimers, and what simply needs precise wording.

    Three levels of restriction, not one

    Business owners tend to think in terms of "allowed / not allowed". In practice the law works on three levels, and most moderation rejections happen on the third — the least obvious one.

    1. Outright ban. The product cannot be advertised at all, in any channel.
    2. Conditional permission. You may advertise, but with mandatory warnings, placement restrictions, or only if you hold a licence.
    3. General requirements for any advertising. These apply to everyone, from a coffee shop to a car service: state language, recognisability as advertising, accuracy, correct promotion terms.

    What is banned outright

    Tobacco and everything connected to it. Since 2022 Ukraine has an effectively complete ban on advertising tobacco products, e-cigarettes, liquids, hookah mixes and consumption devices — along with event sponsorship. This is the simplest category: there is no "version with a disclaimer", the advertising simply does not exist. Vape shops and hookah bars can communicate as venues, but not as sellers of nicotine products.

    Prescription medicines. Advertising prescription-only drugs to a general audience is prohibited. A pharmacy can still advertise itself as a business — opening hours, address, service, OTC lines.     Goods and services that cannot legally be sold. An obvious but regularly broken category: anything you cannot legally sell, you cannot legally advertise.

    What is allowed — but with mandatory elements

    Alcohol

    Beer, wine and spirits can be advertised, but the creative must carry a health warning, and by law it takes up a visible share of the layout, not a fine-print line at the bottom. A separate geographic restriction applies: alcohol advertising is not placed inside or on the grounds of educational institutions, healthcare facilities or sports venues, nor in their immediate vicinity (the law says 100 metres). For screens inside venues this matters a lot: before booking a location, check that there is no school or clinic next door.

    OTC medicines and dietary supplements

    Over-the-counter products can be advertised, but the creative must carry a warning that self-medication may be harmful, plus a recommendation to consult a doctor and read the leaflet. You may not guarantee an effect, cite specific recovery cases, or use images of doctors and pharmacists in a way that implies their endorsement.

    Dietary supplements are a separate trap. They are not medicines, and presenting them as treatment is prohibited: no "relieves pain", "heals joints", "restores the liver". What is allowed: composition, purpose as a dietary addition, and the mandatory "dietary supplement" labelling.

    Medical services

    A clinic, practice or private specialist may advertise if they hold a valid medical practice licence. The key prohibitions: promising a guaranteed result, advertising methods not approved by the Ministry of Health, and using "before/after" photos as proof of treatment efficacy. Cosmetology and dentistry most often stumble exactly here — a creative that guarantees a result will not clear moderation.

    Gambling and betting

    The fastest-changing category of all. The stable core: a mandatory gambling-addiction warning, a ban on any orientation towards minors, and a ban on presenting gambling as a way to earn money or solve financial problems. Regulation of this niche continues to tighten through 2026, so the current status is worth checking separately before launch.

    Financial services and loans

    This category has the most formal text requirements. An ad for a financial service must include the company's full name and details of its licence or registration. For loans, you must state the real annual percentage rate and the estimated total cost of credit — in type that is genuinely readable. Promising or guaranteeing returns is prohibited.

    On a screen a viewer watches for 10–15 seconds, that requirement turns into a design problem: the mandatory block takes up space, so the layout has to be built around it rather than having it bolted on at the last minute.

    General requirements that apply to everyone

    The most frequent rejections are not about a "banned category" — they are about these points.

    • State language. Advertising is distributed in Ukrainian. A trademark may stay in its original spelling, but the advertising copy itself must be Ukrainian.
    • Recognisability. Advertising must be clearly distinguishable from other information. Hidden advertising is prohibited.
    • Accuracy. No "best in Kyiv" or "#1" without proof — that counts as unfair advertising.
    • Promotions and discounts. If you advertise a price reduction, you must state the place and the start and end dates of the promotion. This is the single most common small-business mistake — details in How to advertise a promotion or discount locally.
    • Comparison with competitors. Comparative advertising is only permissible under strict conditions and on the basis of verifiable data. The simplest route is not to compare directly.
    • Children. You may not encourage minors to buy, and the use of children's images in ads for non-children's products is restricted.

    What this means specifically for a screen in a coffee shop

    An indoor screen is a public space with a mixed audience. That changes the calculation in several places at once.

    The audience is not 18+. People bring children into coffee shops. Even where a format is legally permissible, an age-sensitive creative on a screen in the seating area feels out of place and damages brand perception. A bar is a different situation from a coffee shop in Obolon — which is why the category is always matched against the specific location.

    No sound means every disclaimer must be on screen. Radio and TV can voice a warning. An indoor screen runs muted, so every mandatory element — the health warning, the loan rate, the "dietary supplement" label — has to be visually present for the whole duration of the spot, not flashed in the final frame.

    Checklist before uploading a creative

    1. The product category is not on the outright-ban list (tobacco, vapes, prescription medicines).
    2. All mandatory warnings are in the layout and legible from 3–4 metres away.
    3. The copy is in Ukrainian; the trademark may stay in its original form.
    4. No unproven superlatives such as "#1" or "the best".
    5. If it's a promotion — the place and the start and end dates are stated.
    6. For financial services — company name, licence details, real annual rate.
    7. For medical services — a valid licence and no guaranteed results.
    8. The screen's location has been checked for proximity to a school or medical facility, if the category requires it.

    Summary

    Most small businesses — coffee shops, barbershops, service providers, retailers, courses — fall into no restricted category at all. For them, complying with the advertising law comes down to four things: Ukrainian copy, honest claims, correct promotion terms, and no unproven "best in Kyiv". Regulated niches — alcohol, medicines, healthcare, finance, betting — need extra attention to the layout, but they work too, as long as the mandatory elements are designed in from the start rather than added at the end.
